General Terms and Conditions
Adrian & Diego Mathier Nouveau Salquenen regulates the following points in the General Terms and Conditions: Validity of the GTC, conclusion of the contract, deliveries, prices, VAT, customs costs for customers abroad, foreign currency, returns, incorrect deliveries, defective items, return of tap wines, transport damage, care and handling of the wines, payment options, general liability, retention of title, references/hyperlinks, changes to the GTC and the applicable law/jurisdiction.
1. validity of GTC
The GTC apply to all services provided by Adrian & Diego Mathier Nouveau Salquenen AG and are valid in the version valid at the time of the order when a contract is concluded. Deviating regulations on the part of the contractual partner are therefore not valid. By sending an order to Adrian & Diego Mathier Nouveau Salquenen AG, the customer confirms that he has read these GTC and expressly declares his agreement with them.
2. conclusion of a contract
Purchase contracts are concluded when the order is accepted by Adrian & Diego Mathier Nouveau Salquenen AG. Acceptance of the order is confirmed to the customer by e-mail and is subsequently binding for the customer. The customer will also be informed as soon as possible by e-mail of any obstacles to delivery. By placing an order, the customer confirms that he is aware of the scope and content of his order. Questions in this connection can therefore be clarified with us in advance.
3. deliveries
The goods are always delivered by post or a transport company. If, in exceptional cases, an item in our range is not available, the customer will be informed as soon as possible by e-mail. In principle, we reserve the right to make a partial delivery if this appears to be conducive to the fastest possible processing of the overall delivery. We also reserve the right to fulfill an order only to the extent that the articles are available to us.
In principle, the stated readiness for dispatch of the articles is based on experience and is therefore not binding for Adrian & Diego Mathier Nouveau Salquenen AG.
4. price information
In principle, we try to offer our customers the products at the best possible price, but this is closely linked to the prices of our suppliers. Adrian & Diego Mathier Nouveau Salquenen SA therefore expressly reserves the right to adjust the prices quoted online without prior notice and without further explanation. For ordering and delivery, the principle applies that the time of the order on the website is valid for the calculation of prices.
5. value added tax
The prices for Switzerland and the Principality of Liechtenstein include the statutory value added tax of 8.1%. Our VAT number is CHE -106.817.371.
6. customs costs for customers abroad
Orders on www.mathier.com are sent exclusively to Switzerland and the Principality of Liechtenstein.
7. prices
Prices are shown in Swiss francs and are also payable in Swiss francs.
8. returns
A right to return the ordered goods only exists in the event of incorrect delivery by Adrian & Diego Mathier Nouveau Salquenen AG, production defects or transport damage that has occurred in the course of delivery. We therefore expressly ask our customers to check the delivery promptly upon receipt for any defects. Adrian & Diego Mathier Nouveau Salquenen AG must be informed immediately of any faults or defects in the delivery. If there is a defect or damage for which Adrian & Diego Mathier Nouveau Salquenen AG is responsible, Adrian & Diego Mathier Nouveau Salquenen AG is entitled to choose between replacement or rectification of the defect. The goods must be returned in their original packaging, unused and complete.
Incorrect delivery
In the event of incorrect delivery, Adrian & Diego Mathier Nouveau Salquenen AG agrees to deliver the correct item(s) to the customer if possible or otherwise to settle the order with a corresponding replacement (at the customer’s discretion) with the same value of goods. Cancellation of the order is not possible as long as the ordered item is available.
Defective items
Defective or damaged items are always examined by us for the corresponding defects in order to ensure the warranty claim. Adrian & Diego Mathier Nouveau Salquenen AG will treat damage caused by faulty material or manufacturing errors in the same way as the provisions for incorrect delivery. In principle, the contractual relationship will not be terminated in the above cases.
Return of tap wines
Wines with a tap taste will be refunded if the fault can be determined and the bottle is at least 75 percent full. If the same vintage is still available, the tap wine will be exchanged, otherwise it will be refunded in the form of a voucher. This regulation applies for three years from the date of purchase. This excludes wines sealed with synthetic corks or screw caps or wines that have exceeded the recommended drinking age.
Damage in transit
In the event of damage in transit, a report detailing the damage must be sent by email to [email protected] within 48 hours of receipt of the goods, otherwise the right to a free replacement expires.
In the event of an incorrect return, any costs incurred by Adrian & Diego Mathier Nouveau Salquenen AG in the course of returning the goods will be charged to the customer.
The customer is granted a period of 5 working days from receipt of the goods within which the goods can be returned together with the notice of defects.
Please note that a return will never result in a refund as long as the ordered goods are available. We reserve the right to reimburse the corresponding value of the goods with a voucher or an equivalent item.
The shipping costs are always to be borne by the customer. Unfortunately, returns with insufficient postage cannot be processed. The shipping costs will only be refunded to the customer if the delivery is a wrong delivery by Adrian & Diego Mathier Nouveau Salquenen AG or if there is production or transportation damage.
Items excluded from exchange
Due to the significant price reduction, items that have been written off cannot be exchanged.
9. care/handling of the wines
Adrian & Diego Mathier Nouveau Salquenen AG accepts no liability whatsoever for misconduct on the part of the customer in the care and/or handling of the items supplied. We therefore ask customers to observe the relevant instructions.
10. payment options
The customer has the payment options specified in the order process at his disposal.
Adrian & Diego Mathier Nouveau Salquenen AG is the direct contact for billing and payment issues for customers who make purchases in the online store.
Adrian & Diego Mathier Nouveau Salquenen AG reserves the right to exclude customers from individual payment options without giving reasons or to insist on payment in advance. If payment is made in advance, the amount must be transferred within 15 working days.
Adrian & Diego Mathier Nouveau Salquenen AG may charge default interest of 7% per annum and a reminder fee of a maximum of CHF 20 per reminder if the customer is in default of payment. In the event of debt collection, the customer will be charged a processing fee of CHF 100.
11. liability in general
We hereby expressly point out that no liability claims can be asserted against Adrian & Diego Mathier Nouveau Salquenen AG.
12. reservation of title
The delivered goods remain the property of Adrian & Diego Mathier Nouveau Salquenen AG until full payment has been received.
13. references/hyperlinks
We expressly declare that we have no influence whatsoever on the linked pages. We hereby expressly distance ourselves from all content on all pages that can be accessed via a link from our website. This declaration applies to all links displayed on the www.mathier.com website and to all content of the pages to which the links lead.
14. amendment of GTC
It should be noted at this point that Adrian & Diego Mathier Nouveau Salquenen AG reserves the right to amend these GTC at any time in the interests of the company without prior notice. In the event of a contract being concluded, the version of the GTC at the time of the order shall apply.
15 Applicable law/jurisdiction
In any case, the relationship between the customer and Adrian & Diego Mathier Nouveau Salquenen AG is subject to Swiss law in accordance with the provisions of the Swiss Code of Obligations and the Swiss Civil Code, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is the location of Adrian & Diego Mathier Nouveau Salquenen AG.
